The U.S. Congress created the Federal EB-5 Visa Program in 1990 to stimulate the U.S. economy by creating jobs through capital investment by foreign investors.

The EB-5 Visa Program, regulated by the U.S. Department of Immigration (USCIS), grants the foreign investor, his or her spouse and unmarried children under 21 years of age a Green Card for permanent residence in the United States upon investment in a residential or commercial construction project that generates at least 10 jobs for U.S. workers.

The required investment can be US$1,050,000 or US$800,000 depending on the area where the project is located.  According to The EB5 Reform and Integrity Act (RIA) effective since March 2022, EB5 projects located in areas of greatest interest to the U.S. government, called TEA (Targeted Employment Area), give the benefit to the foreigner to invest with the minimum investment amount of US$800,000 and additionally achieve a faster processing for their EB5 visa through the I-526E form.

Investments under the Federal EB5 Visa Program must be made under the supervision and control of a Regional Center, which is a USCIS-certified entity. Additionally, real estate development projects must be approved by USCIS through the Form I-956F Exemplar, because they must demonstrate job creation through a Business Plan and an Econometric Study

The application process is simple and has 4 important points:
Demonstrate the legal source of the capital investment.
The investor must be represented by an immigration attorney.  The immigration attorney will submit the EB5 Visa petition (I-526E) before the U.S. Citizenship and Immigration Services (USCIS).
The U.S. Immigration Office (USCIS) will grant Permanent Residency in an average time of 12 months (If applying for an EB5 project with TEA Rural designation).
Once the immigration process is completed, the Project will return the principal plus interest.

E2 Visa Investments to establish your own business and live in the USA

The E2 Visa is a nonimmigrant visa that allows a foreign national and his or her immediate family to invest a substantial amount of capital in a U.S. company and achieve the benefit of living and working permanently in the United States.

The only Latin American countries that can apply for an E2 Visa are: Argentina, Chile, Colombia, Costa Rica, Mexico, Panama, Honduras and Paraguay.

Some of the countries in Europe that can apply for an E2 Visa and that many Latin Americans have dual citizenship are: Spain, Germany and Italy.

Investment Conditions of E2 Visa

Being a citizen of a country which the United States maintains a treaty of commerce and navigation: (Argentina, Chile, Colombia, Costa Rica, Mexico, Panama, Honduras, Paraguay, Spain, Germany and Italy).
The investor should have already invested, or be actively in the process of investing, a substantial amount of capital in a U.S. company.
The investor has the objective of developing and managing the investment enterprise. This is established by showing ownership of at least 50% of the enterprise or possession of operational control through a managerial or other corporate position.
Passive or speculative investments, such as the purchase and sale of real estate, do not qualify as a substantial investment.
Children are covered by the E2 Visa up to the age of 21.

To apply for this visa, the investor must have a valid B1/B2 tourist and business visa or the Visa Waiver Program (ESTA). It is preferable to make the investment in the business, start it up and then apply for the E-2 Visa, which can be done if the investor comes to the United States.

YES, YOU DO. The contract establishes the total recovery of the capital plus an interest rate. The period of return of capital varies according to the conditions of each project, which can be from 3 to 6 years.
Does my capital generate interest while it is invested in an EB5 Project?
YES, IT DOES. The contract establishes the annual interest associated with your capital. It can vary from 0.25% to 5%, according to the Project you choose.
Can I make a EB5 investment in installments?

No. The fund to be invested can be in an account in your country of residence, in the United States or in a third country.
